Steven Carrigan

Experience:
Steven originally trained with Denton Wilde Sapte and was subsequently a commercial litigator with that firm specialising in pensions and trusts litigation. Following his divorce and being awarded “custody” (now called residence) of his children he could no longer travel to the City. He joined the Worthing firm of Lings and set up a general litigation and family department from scratch.

He continued to handle commercial instructions including e.g.

- defending search and seizure proceedings for what is now a leading company in its field (but would have been strangled at birth had those proceedings not been defended) – opponents were represented by ASB law - click here
- acting for the owner of baa.com against British Airports Authority in an internet domain name dispute – opponents were represented by Herbert Smith – many website entries, use google and search for “baa” and “bourke” or click here (NB: many of the articles are inaccurate and the client received significantly more than some of them suggest).
- obtaining worldwide freezing orders, etc.

He acts as an advocate in the County Court and in Employment Tribunals and has been instructed in cases that have reached the High Court (see “Reported Cases” below) and the Court of Appeal. He has developed expertise in family law and is writing articles for the leading family law journal (see “Publications” below).

Funding:
Steven is prepared to consider acting under deferred fee agreements (principally in family law), contingency fee arrangements (employment claims) and conditional fee agreements (principally personal injury work but may be available in other areas). Otherwise, he charges the standard rates set by Brighton County Court for himself and his assistants (except that the rates may be discounted for family work).

Reported Cases:

- R (J and P) v West Sussex County Council and Wiltshire County Council [2002] EWCH 1143 (admin) [2002] 2 FLR 1192: Steven was instructed by the applicants in judicial review proceedings concerning the rights of local authorities to disclose confidential information to third parties.
- Dalton v Latham & Others [2003] WTLR 687: Steven acted for the family in resisting an application by Mr Dalton to be allowed to inherit under their uncle’s will despite having been convicted of his manslaughter. This case generated significant media coverage and was also the subject of an Irish television documentary in which Steven appeared.
- A v B (Financial Relief: Agreements) [2005] EWCH 314 (Fam) [2005] 2 FLR 730: Steven acted for A in this important case on the status of past agreements in applications for financial provision on divorce. An article is contemplated reviewing the decisions in this area and whether this case represents a radical departure in favour of enforcing such agreements even in the light of poor legal advice and non-disclosure.

- Land Registration Act 2002 section 46: A Guided Missile [Family Law, September, 2005]: concerns the ability of family lawyers to prevent sale of property by obtaining “overriding priority” even where contracts for sale have been exchanged.
- Chattels, Contents and Assets: The Easy Road to Being Sued for Negligence [Family Law, forthcoming]: concerns the importance of dealing with all assets when drafting compromise Heads of Agreement intended to be final.

Interests:
Literature and computers. Steven has his own website, where he proposes publishing his novel Divorcing Reality in parts and will probably include a legal blog. It is presently under construction but does include the red squirrel lawyer joke.
